We are proud to participate in the judicial screening process, appointing members of Columbian Lawyers Association to the New York Supreme and Civil Court screening panels. The panels convene every April. It is time consuming but rewarding work, contributing to the selection of qualified candidates for election to our Courts.
Each year we sponsor the Rapallo Award Luncheon held in April at the Waldorf Astoria Hotel. This prestigious event and coveted award is named in honor of the first Italian American jurist to be appointed to the New York State Court of Appeals, the Hon. Charles A. Rapallo. The award is presented to an outstanding jurist, attorney, public servant or distinguished citizen. Past recipients of the coveted Rapallo award include: U.S. Supreme Court Justice Antonin Scalia, 2nd Circuit Court of Appeals Justice Guido Calabresi, Appellate Division Justices Anita Florio, Eugene Nardelli and Angela Mazzarelli and NYS Supreme Court Justices Anthony J. Cutrona and Francis A. Nicolai.
Justice Iacovetta has participated in several civic and charitable organizations. His memberships have included serving as an active board member of the Columbian Lawyers Association, First Judicial Department, as a trustee in the Sons of Italy, Uguaglianza, Lodge No. 83, as a member of the American Justinian Society of Jurists, and the Country Club Civic Association. He is also a member of the Bronx County Bar Association and the New York City Bar Association where he has served on several committees and participated as a panel member in CLE programs. He served as an adjunct professor of law at John Jay College of Criminal Justice, as an instructor at the Intensive Trial Advocacy Course at Benjamin N. Cardozo Law School, and participated in the Thurgood Marshall Junior Mock Trial Program. He is the author of several reported judicial decisions in the New York Official Reports and the New York Law Journal. His rewards from professional and community organizations include election in 2013 as a Fellow of the Advanced Science and Technology Adjudication Resource Center (ASTAR), and selection as an Italian American Role Model by the Columbus Alliance in 1998.
The Columbian Lawyers Association, First Judicial Department Scholarship Fund is a 501 (c) (3) tax exempt association. Each year, the Association awards up to (4) four scholarship awards to law students of some Italian heritage presently attending law schools located within the City of New York and the Counties of Nassau, Suffolk and Westchester. Consequently, the awards require that the applicant has already been admitted and completed at least his/her first semester of studies. The award consists of $2,500.00 for each year the student attends law school, for a maximum of three years for day students and four years for evening students. In order for a scholarship award recipient to continue receiving their award after the first year it is granted, the recipeint must confirm in writing to the Chairman that he/she is still enrolled in a qualifying Law School no earlier than October 1st and no later than March 15th of the following year. The Chairman and the Association reserve the right to terminate scholarships for recipients who fail to maintain a minimum GPA of at least 2.5.

The Law Society is overseen by a board of governors known as Benchers, composed of 25 lawyers elected by the registrants of the Law Society, up to six Benchers who are not lawyers and who are appointed by the government, and the attorney general of BC. The attorney general is typically represented in this role by the deputy attorney general. The Benchers are responsible for governing and administering the affairs of the Law Society including setting standards for admission, conduct and competence. These are established through the Law Society Rules. The Law Society is a member of the Federation of Law Societies of Canada, the national coordinating body of Canada’s 14 law societies.

The Chief Justice went on to find that court hearing fees are unconstitutional if they “cause undue hardship to the litigant who seeks the adjudication of the superior court” (para 45). This would be so for impoverished or other litigants who have to “sacrifice reasonable expenses in order to bring a claim” that is neither frivolous nor vexatious (para 46). In short, litigants cannot be prevented from accessing the courts because they cannot afford fees imposed by the government (para 49). The hearing fee at issue had this impermissible effect, because it lacks an exemption for litigants of modest means (exempting only the “impoverished”), and thus “prevents access to the courts in a manner inconsistent with s.96 of the Constitution [Act, 1867], and the underlying principle of the rule of law” (para 64).
