Over the years, we’ve come to learn that every personal injury case is as unique as the various factors and people involved. However, in most personal injury situations, you will need to establish that your injuries and the damages that you sustained, stemmed from a party’s negligence. This typically revolves around comparing the details surrounding the injuring-causing incident and how a “reasonably prudent person” would have acted. If the actions or conduct are found to deviate from those of an otherwise responsible person, they may be considered negligent.
In 1912 Michigan adopted a Workers Compensation Act which incorporated a no-fault system under which the worker no longer had to prove negligence. In return for this no-fault system, the law limited the amount that a worker could recover. Workers are now entitled only to wage loss benefits pursuant to a defined schedule, the cost of medical treatment, and certain rehabilitation services. Under the old system, workers could recover for pain and suffering and other damages that a jury might award. There is no jury in Michigan’s Workers’ Compensation System. Once an employee proves that he or she sustained a work related injury or developed a work related disease, the worker after a defined period of time is permitted to be paid wage loss benefits. Medical expenses are always the responsibility of the employer regardless of whether actual work is missed.

Car accidents can be fatal, leading to death. Aside from this, they cause damage to the vehicle as well as bodily harm once they occur. If you were in an accident and had insurance, you want insurance to cover your medical bills. If you have a loved one who might have died or gotten injured in an accident, you also want to have them compensated for, among other things, medical bills by insurance or whoever is at fault. However, it is important to note that states such as Michigan are no fault states. That means that you are entitled to compensation by insurance whether or not the accident was your fault.

The point of personal injury litigation is to recover compensation for losses related to your injury, known as "damages." Michigan courts will only award actual (or compensatory) damages, which cover actual losses resulting from your injury. Michigan doesn't allow for punitive (or exemplary) damages to be awarded as a punishment for the defendant as other states allow. (See Gilroy v. Conway, 151 Mich. App. 268 (1986).)

Often times, drunk driving and alcohol related car accidents happen as a result of consuming too much alcohol while out at a bar or restaurant. In Michigan and 37 other states, there is such legal statute which could potentially pin the accident on the bar or restaurant for over serving its patrons—DRAM laws. According to the law, if a bar or restaurant continues to serve a customer when said customer is visibly intoxicated, they could be at fault for any potential alcohol related injury done unto another person following the customers exit from the bar. For example, if an intoxicated person causes a car accident that seriously injures the other driver, the other driver has the right to sue the bar or establishment that continued to serve alcoholic drinks to the intoxicated driver.
